THE INFORMATION PROVIDED THROUGH OBSIDIAN MONITORING ADVISORY IS AGGREGATED FROM THIRD-PARTY SOURCES, INCLUDING GOVERNMENT WEBSITES, OFFICIAL GAZETTES, REGULATORY AGENCIES, AND NEWS OUTLETS. OBSIDIAN TECHNOLOGIES DOES NOT AUTHOR, VERIFY, ENDORSE, OR GUARANTEE THE ACCURACY, COMPLETENESS, RELIABILITY, TIMELINESS, OR CURRENTNESS OF ANY INFORMATION DISPLAYED ON OR DELIVERED THROUGH THE SERVICE.
Obsidian Monitoring Advisory acts solely as an aggregator and monitoring tool. The content displayed on the platform originates from external, publicly available sources over which Obsidian Technologies exercises no editorial control.
3.2. No Liability for Third-Party Content
OBSIDIAN TECHNOLOGIES SHALL NOT BE HELD LIABLE, UNDER ANY CIRCUMSTANCES AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FOR ANY ERRORS, OMISSIONS, INACCURACIES, OR MISREPRESENTATIONS CONTAINED IN THE INFORMATION RELAYED THROUGH THE SERVICE. This includes, without limitation:
- Regulatory texts, laws, or legislative summaries that may be incomplete, outdated, or incorrectly sourced.
- AI-generated analyses, summaries, or categorizations of regulatory content.
- Delays in reflecting regulatory updates or changes published by original sources.
- Information sourced from third-party websites that may have been modified, retracted, or corrected after our collection.
3.3. No Professional Advice
THE SERVICE DOES NOT CONSTITUTE LEGAL, FINANCIAL, INVESTMENT, TAX, COMPLIANCE, OR ANY OTHER FORM OF PROFESSIONAL ADVICE. The information provided is for general informational and monitoring purposes only and should not be relied upon as a substitute for professional consultation.

4. User Accounts

5. Subscription and Payment
5.1. Subscription Plans
The Service is offered on a subscription basis. Details regarding subscription plans, pricing, and features are provided on the Service or communicated directly to the User.
5.2. Payment Terms
- Subscription fees are billed in advance for the applicable billing period.
- All fees are exclusive of applicable taxes unless otherwise stated.
- Payments are non-refundable, except where required by applicable law or as expressly stated in a separate agreement.
5.3. Changes to Pricing
We reserve the right to modify subscription pricing at any time. We will provide at least 30 days' notice before any price increase takes effect. Continued use of the Service after a pricing change constitutes acceptance of the new pricing.
6. Acceptable Use
You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms. Specifically, you shall not:

8. Service Availability and Modifications

We reserve the right to modify, update, or discontinue any part of the Service at any time, with or without notice. We shall not be liable for any modification, suspension, or discontinuation of the Service.
9. Limitation of Liability
9.1. Maximum Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF OBSIDIAN TECHNOLOGIES ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
9.2. Exclusion of Damages
IN NO EVENT SHALL OBSIDIAN TECHNOLOGIES, ITS DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:
- Indirect, incidental, special, consequential, or punitive damages.
- Loss of profits, revenue, data, business opportunities, or goodwill.
- Cost of procurement of substitute services.
- Damages arising from or related to reliance on information provided through the Service.
These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if Obsidian Technologies has been advised of the possibility of such damages.
10. Indemnification
You agree to indemnify, defend, and hold harmless Obsidian Technologies SARL, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any rights of a third party.
- Any decision or action taken by you based on information obtained through the Service.

Any dispute, controversy, or claim arising out of or in connection with these Terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the competent courts of Lausanne, Canton of Vaud, Switzerland.
14. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
15. Waiver
The failure of Obsidian Technologies to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver of any term shall only be effective if made in writing and signed by an authorized representative of Obsidian Technologies.
16. Entire Agreement
These Terms, together with the Privacy Policy and any other legal notices or agreements published by Obsidian Technologies on the Service, constitute the entire agreement between you and Obsidian Technologies regarding the use of the Service, superseding any prior agreements.
17. Amendments
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page.
- Provide a notice within the Service where appropriate.
Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
